Stages on processing the application for exemption on guardianship for the Iranian subjects to military service living abroad

1. Referring to the missions of the Islamic Republic of Iran in their place of residence or the closest one to them 2. Completion of the relevant forms and presentation of the asked documents to the mission 3. Sending all the documents through such mission to the ministry of foreign affairs of Islamic Republic of Iran 4. Receiving the authenticated above said documents by the legal agent or parents of the person subject to military service from ministry of foreign affairs (Iranian affairs office) and submit the same to conscription organization- salon 5, guardianship office (military service subjects deputyship) 5. Processing the documents, completing the file and required enquiries and referring the same to the processing board 6. Paying the costs of issuance exemption card and sending the card to the agent Note: those who are not qualified for guardianship exemption shall be issued with notice on dispatch for military service






General documents required for exemptions:

a. Copy of all the pages of ID card and National Card of the person subject to military service and his family members (brothers and sisters) b. 3x4cm photo of the person subject to military service (fully color with white background) c. In case of doing military service, the certificate of the same from the manpower department of the relevant commandership of place of service d. the person subject to military service notice of status (sheet No. 1 of conscription manual) e. vaccination and medical examination sheet of the person subject to military service (sheet No. 2 of conscription manual) for those who have not been dispatched for military service f. medical examination sheet of the brother(s) over 18 subject to military service by the conscription medical council that such brother cannot look after the guardianship subject due to disease or disability g. a 3x4 photo of the subject of guardianship as well as patient relatives of the person subject to military service who need being examined before medical council h. bank slips relevant to the exemption tariffs and the costs on issuance of exemption card (for those who are exempted) i. completed sheet on particulars of the relatives of the person subject to military service (sheet No. 3 of conscription manual) Note: such sheet shall be completed by three relatives of the person subject to military service (except for first degree family members) and notarized accordingly. In case such relatives are not available in Iran, completion of such sheet by trusted people approved by the local police is permissible. j. Death of the relatives of the person subject to military service who prevent his exemption (in case of death)






Special documents for father guardianship exemption include the following:

a. Copy of all the pages of father and his wives ID Cards b. Copy of father national card c. Decision sheet of the medical council on the need to take care of the father younger than 70






Special documents for mother guardianship exemption include the following:

a. Husband death certificate (if so) b. Mother divorce certificate (if so) c. Copy of mother national card d. Decision of the medical council on inability of the father of the person subject to military service in guarding his wife or other brothers of the person subject to military service in taking care of their mother (as the case may be)



Special documents for sister guardianship exemption include the following:

1. Father death certificate 2. Copy of father wives ID Cards 3. Copy of all pages of sister ID card 4. Death certificate of brother-in-law (if sister is married and widowed) 5. Decision of the medical council on nephew on inability of the same in guarding his mother due to disease or disability 6. Decision of the medical council on inability of father or other brothers to guard and take care of subject of guardianship



Special documents for sick brother guardianship exemption include the following:

1. Father death certificate 2. Copy of all pages of brother ID card 3. Copy of brother national card 4. Copy of father wives ID Cards 5. Copy of death certificate of sister-in-law (if brother is married and widowed) 6. Copy of divorce certificate of sister-in-law (if married and divorced) 7. Medical council decision on need or not needing to take care of the brother 8. Decision of the medical council on nephew on inability of the same in guarding his sick father 9. Notarized affidavit of the brother of the person subject to military service on being unemployed and not having fixed income to earn a living 10. Decision of the medical council on inability of father or other brothers to guard and take care of subject of guardianship



Special documents for minor brother guardianship exemption include the following:

1. Father death certificate 2. Copy of all pages of brother ID card 3. Copy of brother national card (if any) 4. Copy of father wives ID Cards 5. Decision of the medical council on inability of father or other brothers to guard and take care of subject of guardianship



Special documents for grandparent guardianship exemption include the following:

1. Death certificate(s) of grandparent children (son or daughter) 2. Death certificate of grandfather (if subject of guardianship is grandmother) 3. Copy of all pages of grandfather and his wives ID cards 4. Copy of all pages of grandmother and her husbands ID card (if subject of guardianship is grandmother) 5. Copy of first page and notes page of ID cards of all the grand sons and grand daughters of the grandparent 6. Response of the registration organization on the changes of authentication instrument of all the deceased children of the grandparent 7. Decision sheet of the medical council on the need to take care of the grandfather younger than 70 8. Decision of the medical council on inability of children or other grand children of the grandparent to guard and take care of subject of guardianship



Special documents for guardianship exemption of a person subject to military service whose wife has passed away and has a minor child from her or that his wife has become disabled after marriage include the following as the case may be:

1. Copy of all pages of the person subject to military service and his wife and children ID cards 2. Death certificate of wife (if so) 3. Copy of marriage certificate 4. Certificate on disability from welfare organization 5. Enquiry on decision of medical council in need to take care of disabled wife 6. Enquiry from registration organization of the place of issuance of ID cards of the person subject to military service and his wife on changes of authentication instrument 7. Photo of child or disabled wife



Special documents for exemption due to death during service include the following:

1. Death certificate of deceased person 2. Certificate issued by the relevant manpower department on death during service 3. Copy of ID card of father, deceased person, person subject to military service and his brothers 4. Copy of the documents relevant to the status of military service of brothers of the person subject to military service 5. Enquiry the registration organization of the place of issuance of the ID card of father of the person subject to military service 6. In case there is more than one qualified brother, written non-notarized consent of the step mother or mother of the deceased person as the case may be 7. In case the deceased person has sons, copy of such sons ID cards






Conditions of being qualified for guardianship exemption:

Those none-absent persons subject to military service that merely the son or brother or grandson over 18 is healthy and has any of the following conditions may use guardianship exemption.

Note: medical examinations on father or brother guardianship exemption who needs being taken care, if residing overseas, shall be made in the medical council of the Iranian living abroad (in Dubai (UAE) and Munich (Germany)) and also regarding the cases when the father or brother of the person subject to military service living in Iran, the procedure of medical examinations shall be made through the local conscription office.

1. Being the only healthy son over 18 for father older than 70 2. Being the only healthy son over 18 for father younger than 70 who needs to be taken care of as approved by conscription medical council 3. Being the only healthy son over 18 for the mother who has no husband 4. Being the only healthy grandson over 18 for grandfather who has no child and needs to be taken care of as approved by the medical council of conscription organization or the grandfather who is older than 70 5. Being the only healthy grandson over 18 for grandmother who has no husband and child healthy over 18 6. Being the only healthy brother over 18 for a brother older than 18 who needs to be taken care of and who has no father, wife, child and job 7. Being the only healthy brother over 18 guarding sister who has no father, husband and able son 8. Being the only healthy brother over 18 for a brother younger than 18 who has no father 9. Being one of the children of the disabled parents (one or both) and/or at least two of their children are disabled shall resulted in being exempted from military service


Note: those husband who guard their disabled wives are exempted from military service until such guarding continues





Stages on processing the application of qualified persons subject to military service to obtain guardianship exemption include the following:

1. In case the person subject to military service lives overseas and those he claims to guard live in Iran, then the political and consular mission of Iran in the country of residence shall authenticate the application of the person subject to military service mentioning the type of exemption and send the same to ministry of foreign affairs to be presented to the conscription organization. the deputyship of the persons subject to military service exemptions affairs shall also send such documents to the conscription administration of the relevant province to be processed in the city of residence of person who has been claimed to be guarded by the person subject to military service, after which processing shall be made like other persons subject to military service and without any need for attendance of the person subject to military service before processing panel 2. In case the person subject to military service lives domestically and those subject to guardianship live abroad, then the political and consular mission of Iran in the country of residence shall complete the needed documents as per the type of exemption through reference of beneficial people and send the same to ministry of foreign affairs to be presented to the conscription organization. Evidently, the application of such persons subject to military services shall be sent to the conscription administration of the relevant province to be processed in the city of residence of such person. The case of such persons subject to military service shall be referred to the conscription of Tehran after the relevant documents were processed by the deputyship of persons subject to military service and exemptions affairs and the agent appointed thereof shall make the follow ups relevant to the same through such office. Regarding appointing agent, the person subject to military service is not obliged to select the same from amongst those who are real lawyers and may appoint his relatives or friends as his agent. 3. The documents to be submitted for the persons subject to military service mentioned in clause 1 shall be like the other persons subject to military service and be the documents mentioned in the conscription manual, while through completion of the relevant parts in the guardianship exemption application sheet special for the Iranian living overseas, the same shall be authenticated by the processing missions. Regarding the persons subject to military service mentioned in clauses 2,3, in addition to the documents mentioned as well as completion of the relevant parts in the guardianship exemption application sheet special for the Iranian living overseas to be authenticated by the processing mission, the number of potential marriages and sons born overseas authenticated by the ministry of foreign affairs shall be enclosed to the case.
